Gallery Protection – 36 Months of Coverage for Stains, Rips, Tears, Burns & Electrical

A step up from the Designer Studio Protection, the Designer Gallery Protection provides 36 months of enhanced coverage. In addition to protecting against the most common household stains, this plan also includes coverage for rips, tears, burns, and electrical components.

Plan coverage begins when your client's first item is delivered. There are no waiting periods required to file a claim. If an accidental stain occurs on day one, your client is covered. This is not a simple replacement plan; our goal is to return damaged items to "like new" condition because we know how hard you worked to select the perfect items for your client.

This comprehensive plan applies to a wide range of furnishings, including: Indoor furniture, outdoor furniture, adjustable bed bases, and rugs.

Coverage begins the moment your client’s first eligible item is delivered—with no waiting period. If an accident happens on day one, they’re protected. This isn’t a simple replacement plan. Our mission is to restore damaged items to “like new” condition, because we understand the effort and care that goes into every design decision.

Definitions

"We," "Us," and "Our" means Risk Assurance Partners, LLC, the “Administrator” of this Plan who is obligated to provide services described in this Plan.
“Guarantor” means Risk Assurance Partners, LLC, the party that is financially obligated under this Plan.
“Plan Holder” means (i) "You" or "Your" the individual described in the Receipt that purchased this Plan and who is eligible to receive all benefits under this Plan; or (ii) under lease to own (“LTO”) arrangement, the person that who acquired this Plan and who is entitled to receive repair services (but no cash or replacements) under this Plan; or (iii) the person who becomes the owner of the Items under an LTO arrangement and who is entitles to receive all benefits under this Plan.
“Plan” means this protection plan.
“Plan Number” means a unique number that We may issue to activate this Plan – this Plan is not valid for coverage without a Plan Number issued by Us.
“Term” means the months Your Item(s) have coverage under this Plan.
“Item(s)” means new Item(s) that are listed on the same sales receipt as this Plan and listed under the Eligible Items section of this Plan.
“Retailer" means the Interior Designer that sold You this Plan.
“Claim” means a request for repairs or payment of Item(s) covered under this Plan.
“Sales Receipt” or “Receipt” means the sales receipt provided to you by the Retailer that shows Your purchase of this Plan and the Eligible Items.

YOUR RESPONSIBILITIES

Read these Terms & Conditions, including the Coverage and Exclusions sections carefully. If You have any questions, please call us toll free at [<insert number>], We are here to help.

You must obtain a Plan Number from Us within ten (10) days of purchasing this Plan. You will have NO coverage under this Plan without first obtaining a Plan Number from Us. Visit on any web connected device [<insert URL>] or call Us at [<insert number>] or email Us at [<insert email address>].
We reserve the right to NOT issue a Plan Number. If We exercise this right, We will explain Our reason(s) and refer you back to the Retailer that You purchased this Plan from for a refund.
You agree that only the Items described on the Receipt and below are covered by this Plan.
You agree to perform all inspections, maintenance, repair, and warranty services for the Item(s), that are required by the manufacturer (collectively the required “Maintenance”) and to follow the manufacturer’s use and care instructions.
You agree that this Plan is not an Insurance Policy and that this Plan does not cover damage or failures that are covered by a Manufacturer’s or Retailer’s warranty.
You agree to follow Our processes, and cooperate with Us, when filing claims under this Plan.
You also agree when filing a claim under this Plan to (i) to present a sales receipt showing Your purchase of this Plan and the Item(s) covered by this Plan, each on the same receipt, (ii) to retain a copy of this Plan, and (iii) provide Us with this Plan’s number when filing a claim together with required photos of damages.
This Plan is not valid unless it is purchased from a Retailer that We have authorized to sell this Plan.

ELIGIBLE ITEMS & COVERAGE – READ CAREFULLY

ELIGIBLE ITEMS

This Plan only covers the following “Items” that are manufactured for indoor residential use: Upholstery primarily made from Fabric (excluding “x” coded and silks), Leather, Faux Leather, Vinyl; Livingroom, Case Goods, Dining Room, Bedroom, Home Office, Accessory Furniture primarily made from quality materials that are commonly used to manufacture such Items (excludes ready to assemble furniture); Machine Made Rugs made from wool, nylon, polyester, olefin, and other commonly used materials (excludes rugs made from silks or that are unique one of a kind pieces); and Lamps. See the Exclusion section for a list of items that are NOT covered under this Plan. To be eligible for coverage Items must be purchased concurrent with this Plan from the Retailer that sold you this Plan.

COVERAGE START, END DATE & RESTRICTIONS

Plan coverage begins upon the start of the Term and ends upon expiration of the Term. Plan start and end dates are described on the last page of this Plan. This Plan does not replace manufacturers’ warranties for covered Item(s). This Plan is not a maintenance plan or an insurance policy. You must report and file claims within fifteen (15) days of noticing the damage or failure. Reporting issues to Us promptly improves the chances that the damage or failure can be resolved. EXCLUSIONS – READ CAREFULLY

While this Plan provides many valuable Coverages, to keep this Plan affordable We have excluded some items and certain types of damage from being covered. Only the Items and Coverages described on the prior page of this Plan are covered.

DAMAGE NOT COVERED

Anything listed in the Coverage section of this Plan and damages covered by another warranty or policy and all pre-existing damage.
Failure to care and maintain Items; improper use of Items; using Items outdoors or on porches; Transit or storage even if stored in Your home.
Odors; discoloration; color loss; fading; mold; mildew; caustic substance; wear and tear, general soiling; build-up over time; hair or body oils and sweat.
Structure, mechanical, normal surface wear, chips, scratches, design flaws, dye lot and texture variations.
Teeth, claws, beaks or any infestation or wild animal.
Modifications; accessories; rust; batteries; electrical surges; cleaning products; services or repairs not authorized by Us.
Chronic medical conditions or from habitual behavior.
Acts of God; war; riot; pearl; terrorism; civil unrest; weather; sun; flood; wind; rain; environmental; fire; smoke; hurricanes; tornados; blizzard; lightening; and any weather pearl or related events.

ITEMS & OTHER ISSUES NOT COVERED

Item(s) that are not listed on the same sales Receipt as this Plan as being covered and Items that do not remain in Your possession.
Items not sold by the Retailer that sold You this Plan or sold “as-is” or previously owned item(s).
Showroom, floor samples, or outlet item(s), Item(s) that were previously damaged or defective and Item(s) damaged or stained in transit to or from Your residence.
Item(s) used for commercial purposes, including at home businesses and Item(s) used for or in connection with day care or adult care.
Functionality, merchantability & fitness for use, breach of warranty, assembly, or installation.

REQUIREMENT TO MAINTAIN ITEMS

This Plan does not eliminate the need for routine care and maintenance of the covered Items and such care and maintenance is solely Your responsibility. General soiling and wear and tear (defined as a gradual buildup or accumulation of dirt, dust, body oils, perspiration, and damage that cannot be attributed to a single incident) are not covered under this Plan, except to the extent described in Tier Two coverage, and then subject to Plan exclusions.

OBTAINING SERVICE & SERVICE PROCESS

DEDUCTIBLE

This Plan has no deductible.

INSPECTING YOUR DAMAGED ITEM(S)

When We receive Your claim, We will review the photos that You provided. At times We need more information, and We may dispatch a technician to Your home to perform a more complete inspection and provide additional photos.

REPLACEMENTS & CREDITS

If We determine that the damage You reported is covered under this Plan, We may take of the following actions:

Replacement: Replace Your damaged Item(s) with a new item of similar quality.
Credit: Issue You a merchandise credit (Credit) equal to the amount that You paid for the damaged Item(s) (excluding tax and delivery fees). Merchandise credits may only be used at the Retailer that sold you the Item(s) and this Plan. Credits may not be exchanged for cash and must be used in full upon their first use (You may not carryover or save unused amounts). Credits expire within six (6) months of their issuance date and may not be reactivated.
Cash: Issue you cash compensation at an amount that We will determine when settling Your claim.

Coverage terminates for damaged Item(s) upon Your receipt of a replacement, credit, or cash compensation.

REPAIRS

If We determine that repair of Your Item(s) is possible, We may do one or more of the following:

Parts: If parts are available for your Item(s), we may order them, and, depending on the part, make the necessary installation to bring your Item(s) to like new condition. We are not responsible for and shall take no action to correct texture or dye variations of parts from Your original Item(s). If We order parts, We may ship them directly to You, and upon receiving such parts it is Your responsibility to contact Us to let Us know that Your parts arrived.

Tech Service: If We determine that We can repair the damaged Item(s), We will arrange for a 3rd party technician to visit Your home and make repairs. You must cooperate with Our technician otherwise We may void Your Plan. If Your Item(s) cannot be repaired at Your home, We will remove them and return them to You at no additional charge.

OTHER CONDITIONS

YOUR COOPERATION IS REQUIRED

You must cooperate with Us in all respects in Our attempts to review any claim(s) that You make under this Plan or Our attempts to settle Your claims. If You fail to cooperate with Our reasonable respect, for example by not responding within fifteen (15) days of Your receipt of a request from Us for information about Your claim, then We may deny Your claim and You will not be able to file another claim under this Plan for the same damage or failure to the same Item.

FALSE OR MISLEADING INFORMATION

Fraud increases costs for everyone. If You submit any false or misleading information to Us or intentionally provide Us with Fales or misleading information, then, at our sole discretion, We may:

Deny Your claim and You will not be able to file another claim under this Plan for the same damages; or
We may cancel this Plan in accordance with the provisions of this Plan.

UNAUTHORIZED SERVICE, REPAIRS & OTHER CONDITIONS

All service and repairs must be authorized by Us in advance. This Plan does not cover damage from 3rdparty cleaning or care products.
If We dispatch a service technician to Your home and You subsequently refuse service upon Our technician’s arrival, You agree to pay to Us, upon Our demand, Our reasonable costs arising from dispatching the technician.
Service on Items covered by this Plan are limited to only to the damages described under the Coverage section of this Plan and only those Item(s) sold to you by the Retailer and listed on the same sales Receipt as this Plan.
Only Items that remain in Your possession are covered by this Plan.
This Plan is not a cleaning contract and does not eliminate the need for You to provide routine care and maintenance of Your Item(s). Maintenance of Your Item(s) is solely Your responsibility.

TRANSFERS, LIABILITY & WAIVER

PLAN IS NOT TRANSFERABLE, NO ASSIGNMENT OF BENEFITS

This Plan, together with all its benefits and rights accruing to You, are NOT transferable or assignable. This prohibition against transfer and assignment of benefits and rights under this Plan includes, for example, any rights You may have to litigate or otherwise file a suit or legal action under or arising from this Plan. In the event that a court or regulatory body of competent jurisdiction determines that You may transfer, hypothecate, or assign any benefits or rights accruing to You under this Plan, You agree that We shall have the exclusive and first right to purchase all of Your rights and benefits under this Plan for ten ($10.00) dollars, which You acknowledge is good, adequate, and valuable compensation for such rights and benefits. Furthermore, You agree that in the absence of a determination by a court or regulatory body, if you attempt to transfer, hypothecate, or assign any of Your rights under this Plan, that We shall have the first right of purchase of all Your rights and benefits under this Plan for ten ($10.00) dollars, which You agree is good and valuable consideration received for such rights and benefits.

OUR LIABILITY LIMITS

The limit of liability under this Plan is the lesser of (a) the amount that You paid for the covered and damaged/non-functional Item excluding sales tax, delivery, and handling or (b) five thousand ($5,000.00) dollars, which means that Our maximum liability and obligation to pay or service claims under this Plan shall in no event exceed five thousand ($5,000) dollars. This Plan expires upon the earliest of the term of the Plan expiration date shown on the last page of this Plan or payment of compensation to You for an Item covered by this Plan, or, in lieu of compensation, replacement of an Item covered by this Plan.

SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES

IN NO EVENT SHALL WE BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER IN CONTRACT, TORT, OR NEGLIGENCE, INCLUDING LOSS OR DAMAGE TO PERSON OR PROPERTY ARISING FROM THE USE OF, OR INABILITY TO USE, OR FROM THE REPAIR OR REPLACEMENT OF AN ITEM.

CLASS ACTION WAIVER

EACH PARTY HEREBY AGREES TO WAIVE THE RIGHT TO LITIGATE IN COURT OR ARBITRATE ANY CLAIM OF DISPUTE AS A CLAS ACTION PROCEEDING, WHETHER IN LAW OR EQUITY, EITHER AS A MEMBER OF A CLASS OR AS A REPRESENTATIVE, REGARDLESS OF WHICH PARTY BRINGS SUIT, OR TO ACT AS A PRIVATE ATTORNEY GENERAL. THIS WAIVER SHALL APPLY TO ANY MATTER WHATSOEVER BETWEEN THE PARTIES (INCLUDING OUR AFFLIATES AND ASSIGNS) WHICH ARISE OUT OF OR ARE RELATED IN ANY WAY TO THIS PLAN, OUR PERFORMANCE UNDER THIS PLAN, OR OUR AGENT'S PERFORMANCE UNDER THIS PLAN.

LEGAL FEES, CANCELLATIONS & OUR RIGHT TO RECOVER PAYMENT

LEGAL FEES

If We incur any legal fees or costs while enforcing the terms of this Plan, including defending against any actions at law in which You are a counterparty, You agree to promptly pay to Us, on demand, Our reasonable legal fees and court costs incurred in connection with the same regardless of the outcome of such proceedings or litigation.

CANCELLATION

This Plan may be cancelled by You for any reason. To cancel this Plan, contact Us at [xxx-xxx-xxxx]. Your rights to cancel this Plan are restricted by the laws of the state that you reside in. If Your state does not regulate cancellations, then these terms apply:

If You cancel this Plan within the first thirty (30) days after purchase of this Plan and no claims have been made hereunder, You will receive a full refund of the Plan purchase price. If You or We cancel this Plan after the first thirty (30) days of purchase or if a claim has been made hereunder, You will receive a pro‐rata refund of the purchase price of this Plan calculated based on the elapsed time since the commencement of this Plan, less any claims paid. If We cancel this Plan, We will provide You with a written notice at least fifteen (15) days after cancellation at Your last known address, with the effective date for the cancellation and the reason for cancellation.

OUR RIGHT TO RECOVER PAYMENT

If You have a right to recover against another party for anything We have paid under this Plan, Your rights shall become Our rights. You shall do whatever is necessary to enable Us to enforce these rights.

GUARANTY, EXCHANGES, ENTIRE AGREEMENT PLAN HOLDER INFORMATION

GUARANTY

This Plan is not an insurance policy. We have obtained an insurance policy to insure Our performance under this Plan. Should We fail to pay a claim that is covered by this Plan within sixty (60) days after We settled such claim and have determined that a payment is due You, or in the event You cancel this Plan and We fail to refund the unearned portion of the Plan purchase price, You are entitled to make a direct claim against the insurer, [<enter name Insurance Company, at < enter phone number> or by mail at <enter street, city, state, and zip>].

IMPORTANT INFORMATION ABOUT EXCHANGES

If Item(s) covered under this Plan is exchanged by the manufacturer or retailer, Plan coverage does not extend to the replaced or exchanged item.

ENTIRE AGREEMENT

THIS PLAN, INCLUDING THE TERMS, CONDITIONS, LIMITATIONS, EXCEPTIONS AND EXCLUSIONS, AND THE SALES RECEIPT FOR YOUR COVERED ITEM(S), CONSTITUTE THE ENTIRE AGREEMENT BETWEEN US AND YOU AND NO REPRESENTATION, PROMISE OR CONDITION NOT CONTAINED HEREIN SHALL MODIFY THESE ITEMS, EXCEPT AS REQUIRED BY LAW.
